Deportation Defense

The Federal Government defines Deportation as the formal removal of an alien from the United States when the alien has been found removable for violating the immigration laws. Deportation is ordered by an immigration judge without any punishment being imposed or contemplated. Prior to April 1997 deportation and exclusion were separate removal procedures. The Illegal Immigration Reform and Immigrant Responsibility Act of 1996 consolidated these procedures. After April 1, 1997, aliens in and admitted to the United States may be subject to removal based on deportability. Now called Removal, this function is managed by U.S. Immigration and Customs Enforcement.

Q: Is it only criminals that have to worry about deportation?

A: Deportation is not a threat just to hardened criminals and dangerous felons. It is a real reality for anyone who has an illegal status in the United States

Q: If I have a green card, do I still have to worry about deportation?

A: You can get placed in deportation (now called removal) if you apply for an immigration benefit and get denied. You could be a Lawful Permanent resident, and still end up in Removal proceedings. You may have been out of country for longer than a year; arrested for a Domestic Violence offence, or other felony. There are many ways this could happen to someone.

Q: If I end up in deportation, what should I do?

A: Immediately consult an immigration attorney, once who spends a lot of time on these cases. Early intervention might make a big difference.
